The Bombay High Court hearing will resume today for Aryan Khan

Highlights from Shah Rukh Khan’s son Aryan Khan’s bail hearing: The Bombay High Court will continue to hear Aryan Khan’s bail application in the matter of an alleged drugs bust on a cruise liner on Thursday. Aryan Khan is the son of actor Shah Rukh Khan. Today, the Narcotics Control Bureau (NCB) will present its case to the court.

Senior Advocate Amit Desai argued before Justice Nitin W Sambre’s single-judge bench on Wednesday that the NCB’s arrests in the case were “illegal” because the agency failed to follow procedure mandated by section 41A of the Criminal Procedure Code (CrPC), which requires the investigating officer to issue a notice of appearance prior to arrest. According to earlier High Court judgements and rules of the Indian Evidence Act, WhatsApp communications are not admissible in court, according to Desai.

In other news, the Pune city police have ‘nabbed’ Kiran Gosavi, the self-styled detective identified by the Narcotics Control Bureau (NCB) as a “independent witness” in the Aryan Khan drugs-on-cruise case, in connection with a cheating case filed in 2018. Soon after his selfie with Aryan Khan went viral on social media, Gosavi went missing, prompting suspicions about his behaviour during the cocaine bust.

On Tuesday, Mukul Rohatgi, a senior counsel and former Attorney General of India, ended his arguments on behalf of Aryan. Rohatgi described his detention as “arbitrary,” noting that the NCB had made no progress in locating the 23-year-old or conducting a medical evaluation to determine whether he had consumed any narcotics. Aryan has been held since October 2, when he was apprehended before an alleged rave party on a cruise liner.
