Chinese experts have claimed that India’s attitude of being the “regional boss has caused a strain in its relations with regional countries in South Asia” in an editorial published in the state-backed Global Times.

Chinese analysts and experts went on to say that India should not “shift the blame on China” and should instead take a more “open-minded approach” because it seems as though its politicians “lack confidence.”

India’s belief that it is the leader of the region is the cause of its tense relations with some South Asian nations. India ought to pause, consider its policies toward its neighbors, and give up the zero-sum mindset before assigning blame to China, according to analysts cited in the Global Times.

China has also supported the Maldives and Muizzu in the editorial. China has always respected the Maldives’ sovereignty and treated it as an equal partner, according to the report, which also stated that China “never asked Male to reject New Delhi because of the conflicts between China and India, nor does it.

It concluded that New Delhi ought to maintain greater receptivity, given that China’s collaboration with South Asian nations is not a zero-sum endeavor.

Bilkis Bano Case: Rahul Gandhi welcomed the Apex court verdict on the Bilkis Bano case that quashes the Government of Gujarat’s order to allow the early release of 11 convicts in the case. The opposition said it was a victory of justice and accused the BJP of being anti-women and “patronising criminals”.

SUPREME COURT RULING:

In a recent move, the Supreme Court of India on Monday blew at the Gujarat government by cancelling the previous order by the state which released the 11 convicts of raping Bilkis Bano and killing seven of her family members during the 2002 post-Godhra riots in Gujarat. The court ruled that the Gujarat government was “not competent enough” to pass such an order.

The Supreme Court also added that the documents shown to them by the convicts to obtain its 2022 order, which allowed the 11 men to approach the Gujarat government for their premature release were “fraud” and sought through “misleading facts”.

All the convicts were asked to surrender before jail authorities within two weeks were released by the government of Gujarat. As per media reports, the victim, Bilkis Bano, was 21 years old and five months pregnant when she was gang-raped while fleeing the riots that broke out after the Godhra train burning incident in Gujarat on March 3, 2002. Her three-year-old daughter was among the seven family members killed.

Rahul Gandhi stated in his tweet on X, “The tendency to ‘kill justice’ for electoral gains is dangerous for the democratic system. Today, the Supreme Court’s decision once again told the country who is the ‘patron of criminals’,”.

Along with Rahul his sister Priyanka Gandhi Vadra too reacted to the verdict and said justice had ultimately prevailed.

“With this order, the veil over the anti-women policies of the Bharatiya Janata Party has been removed. After this, public confidence in the justice system will be further strengthened. Congratulations to Bilkis Bano for continuing her fight bravely,” she said in a post on ‘X’ previously twitter.

Congress’ spokesperson Pawan Khera also jumped in the case and tweeted on X, (twitter). He said, “It is a slap on the face of those who facilitated the illegal release of these criminals and also those who garlanded the convicts and fed sweets to them, by bulldozing justice.”

Rs 44,015 crore in GST evasion has been found since May 23

On Sunday, the Ministry of Finance said that the Goods and Services Tax (GST) authorities had found 4,153 false companies suspected of evading input tax credit (ITC) worth approximately Rs 12,036 crore between October and December 2023. Of the 36 states and union territories (UT), Maharashtra ranks first with the greatest number of 926 bogus firms that have engaged in suspected tax evasion totaling Rs 2,201 crore. However, Delhi has demonstrated a higher incidence of tax evasion, with 483 bogus firms suspected of evading taxes totaling Rs 3,028 crore.

Haryana leads all states/union territories in the number of fake firms per lakh registered firms, with 81 of them. Delhi comes in second with 61 fake firms per lakh registered firms, Rajasthan with 59 fake firms per lakh registered firms, and Maharashtra with 54 fake firms per lakh registered firms.

Central GST officials found 2,358 of the 4,153 fraudulent companies that were discovered during the October–December quarter. “A total of 41 people have been arrested in these cases, 31 of whom were by Central GST Authorities,” the Ministry statement stated. “This has helped protect the revenue of Rs 1,317 crore, out of which Rs 319 crore has been realized and Rs 997 crore has been protected by blocking input tax credit.”

The Central Board of Indirect Taxes and Customs (CBIC) and state/UT governments, in conjunction with the GST authorities, have been taking action against fraudulent firms to reduce fraud and boost compliance. Tax authorities have launched targeted campaigns against the issuance of false invoices without any supporting supply of goods and services and non-existent/bogus registrations.

In mid-May of last year, a special campaign was launched under GST to combat fraudulent registrations. In April of last year, The Indian Express published a report detailing multiple cases of fraudulent companies avoiding taxes by supplying manpower for services instead of goods from Gujarat to Bihar. These companies did this to avoid creating e-way bills, which are required for the interstate transportation of goods valued at more than Rs 50,000.

Additionally, there have been cases where Aadhaar has connected companies to random people’s mobile numbers. These people then began receiving OTPs and multiple GST registrations from the same address. In many of these cases, fictitious documents were produced. After discussions at the highest levels of government, tax authorities discovered these fraud cases under the GST regime, which led them to launch a special campaign against frauds linked to registration in 2023–2024.

According to the Ministry, since then, 29,273 false companies implicated in alleged ITC (Input Tax Credit) evasion of Rs 44,015 crore have been found. “This has prevented ITC from taking $3,802 crore, saving Rs 4,646 crore; the remaining Rs 844 crore are from recovery. It said that 121 arrests have been made thus far in the cases.

To increase revenue collections, tax authorities have identified registration-linked frauds as one of the main focus areas for tighter scrutiny in the financial year 2023–2024. No significant changes to the GST rate are anticipated before the general elections, which are anticipated to take place in the coming months. The GST registration procedure has prompted the government to take several actions. Three additional states have started pilot programs involving biometric-based Aadhaar authentication during registration: Gujarat, Puducherry, and Andhra Pradesh.

The government has also implemented steps to reduce tax evasion, including the filing of GST returns in a sequential manner, the use of data analytics and risk parameters to identify fake ITC, and the generation of system-generated notifications for reconciling the discrepancies in tax liability between GSTR-1 and GSTR-3B returns and the ITC available under GSTR-2B and the ITC availed in GSTR-3B returns.

Delhi High Court sets deadlines for organ transplant cases

On Thursday, the Delhi High Court set deadlines for the authorization committee to interview potential donors and make decisions regarding organ transplant cases following the Transplantation of Human Organs and Tissues Rules, 2014.

“An organized and timely transplantation decision-making process” as envisaged by the Transplantation of Human Organs and Tissues Act and the 2014 Rules would be “nullified if timelines are not prescribed for various steps,” a single-judge bench of Justice Prathiba Singh declared.

Judge Singh concluded that, in light of the crucial significance of pre-transplantation interviews, deadlines under the 2014 Rules needed to be established. By notification, the state government or Union Territories shall establish one or more authorization committees under the Act. These committees shall be composed of members who may be nominated by the state government or Union Territories under the terms and conditions outlined in the notification.

“Such a time-bound strategy is essential to preserving the efficacy and integrity of organ transplantation protocols. Additionally, this would support Article 21 of the Constitution’s Right to Health. The high court emphasized that internal timelines must still be adjusted to guarantee the authorization committee’s systematic operation, even though the committee’s satisfaction is vitally important to this process.

It further stated that the application for living donor transplantation must be processed within a maximum of 10 days of the date of the application. Within a maximum of 14 days, the documents about the recipient’s and donor’s domicile status must be verified. The court further stated that any chance provided to the donor or recipient to finish the necessary paperwork must be informed to them within the time frame specified by the Rules.

Justice Singh added that the interview ought to be set up in two weeks following the receipt of the application, which should take four to six weeks. It further stated that the committee was to interview the donor and recipient one or two times during these two weeks, arrange for a meeting of the donor and recipient’s families, and communicate the decision.

The court stated, “Ideally, the entire process—from submission to decision—ought not to exceed six to eight weeks.”

The intent, as well as the letter and spirit of the 1994 Act and the 2014 Rules, are all at odds with the prolonged waiting periods of two to three years that have been experienced in certain cases due to non-compliance with timelines. Such protracted wait times can result in severe psychological and physical distress for the recipient and donor, as well as their families. Consequently, the court stated that for the donor/recipient and their respective families to continue with the decision-making process, there must be clear and timely communication regarding the application, whether it be oral or written.

The high court noted in its 42-page ruling that pre-transplant interviews are essential because the authorization committee needs to make sure the donor is not doing this organ donation for financial gain. The court did state that the interview and documentation process must be completed in a “time-bound manner,” failing which the process’s intended outcome may be compromised.

Making decisions quickly is important for both the donor and the recipient, as well as for their families. In actuality, the procedure’s complexity tends to discourage organ donation, which would also be counterproductive to the Act’s intended goal of promoting societal harmony. The high court emphasized that the Act and Rules are meant to regulate organ donation rather than to discourage it.

To guarantee that deadlines under the 1994 Act and 2014 Rules are prescribed for all the steps in the process of considering applications for organ donation, the court called for the judgment to be placed before the Secretary, Ministry of Health and Family Welfare, following consultation with the pertinent stakeholders.

In 2020, a kidney patient filed a plea with the high court, requesting that Sir Ganga Ram Hospital perform a kidney transplant and that the authorization committee provide the required approval. In 2021, the patient had passed away.

In the first session of the series decider at Newlands, South Africa’s Aiden Markram hit a brilliant century for the Proteas in the second inning. while premier pacer Jasprit Bumrah claimed a match-changing six-wicket haul for India. Rohit Sharma and company defeated the Proteas by 7 wickets at Newlands after they chased down the 79-run target with the loss of only 3 wickets. In the final Test of Dean Elgar’s career, India achieved its first-ever victory in Cape Town. India leveled the series 1-1 on Thursday by winning the shortest-ever Test match.

Mo. Siraj was awarded the Man of the Match and the farewell boy Dean Elgar along with Jasprit Bumrah was awarded Player of the Series.

In the press conference, India captain Rohit Sharma said, “We don’t mind playing on surfaces similar to the one in Cape Town, where the fastest-ever test result was attained. In light of the events at Newlands, he wishes for the people who criticize Indian pitches to simply shut up.”

“Everyone witnessed the events of this Test match as well as the pitch’s behavior.
