Telecommunications Bill 2023: What it aims to change for the telecom industry?

In Parliament, the Centre Government introduced the Telecommunications Bill, 2023, on Monday, December 18. The proposed law aims to introduce several structural changes to the industry’s current regulatory mechanisms, including increased user verification requirements, clarity in spectrum assignment, and a more straightforward licensing regime.

The government views these outdated laws from the colonial era as needing reform, especially in light of recent changes to the telecom industry. The Bill aims to replace the Indian Telegraph Act (1885), the Wireless Telegraphy Act (1933), and the Telegraph Wires (Unlawful Possession) Act (1950).

Concerns have also been raised, chiefly about the Bill’s apparent exclusion of Internet-based communication services like Telegram, Signal, and WhatsApp from its purview and the requirements for interception of communications over telecom networks.

Key Points of the Telecom Law

The Bill aims to streamline the telecom networks’ current licensing regime by shifting to an authorization system. The Bill combines more than 100 different licenses, registrations, and permissions that the telecom department currently issues into a single authorization process.

Although auctions will remain the preferred method of allocating spectrum to organizations, administrative allocation will occur for industries other than satellite communications, such as police, community radio, metro rails, defence, and railroads.

The Bill also allows the government to reclaim spectrum underutilized for insufficient purposes and permits spectrum sharing, trading, and leasing. Organizations can turn in any unused spectrum, but the government won’t pay them.

A voluntary undertaking mechanism has been implemented to encourage voluntary disclosure of unintentional lapses and promote compliance. A three-tiered system includes an adjudicating officer, a designated committee of appeals, and the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) at the top for resolving disputes resulting from violations of terms and conditions.

To reduce fraud, entities are required to implement biometric authentication for their users. Users’ privacy has come under scrutiny due to this provision.

In the event of a public emergency, interest, or safety concern, the Bill gives the federal and state governments, or a specially authorized officer, the authority to request interception, disclosure, and suspension powers. Although they can be intercepted for national security purposes, press messages intended for publication in India and those from correspondents accredited to state or federal governments are not subject to interception.

The Bill also gives the Center the authority to assume control and management of telecommunications services and networks in the event of a war or the interest of national security. It was a surprise addition to the Parliament’s agenda late Sunday night.

The Telecommunications Bill 2023 has opened the door for administrative spectrum allocation for satellite broadband services. India is set to follow the global norm in how much spectrum is assigned to entities. This is due to the significant debate surrounding the allocation and auction of spectrum and the fallout from the 2012 SC ruling. Elon Musk’s Starlink, Amazon’s Kuiper, and Bharti Airtel’s OneWeb could all benefit greatly.

The government and a divided industry were at odds over how to assign spectrum for satellite communications, whether through an auction or administrative means. The telecom department even asked the telecom regulator, TRAI, for guidelines on auctioning satellite spectrum.

Telecommunications Bill 2023: The question of Internet service regulation

Though narrowed down, experts and some government officials feel that the current Bill’s definition of online communication services, like WhatsApp, Instagram, and Telegram, has been left open to other platforms as well, potentially initially. This is in contrast to a 2022 draft that had specifically mentioned these services as telecommunication services.

According to the new Bill, telecom services and networks will require authorization from the government unless the government chooses to exempt specific entities in the public interest.

“Transmission, emission or reception of any messages, by wire, radio, optical or other electromagnetic systems, whether or not such messages have been subjected to rearrangement, computation or other processes by any means in the course of their transmission, emission or reception” is the definition of telecommunication that remains unchanged in the new Bill. “Any sign, signal, writing, text, image, sound, video, data stream, intelligence or information sent through telecommunication” is another definition of “messages.”

On the other hand, some think that the definitions categorically exclude online platforms. As recommended by IAMAI, the industry association said in a statement, “The bill introduced in the Lok Sabha now excludes email, internet-based communication services, broadcasting services, machine-to-machine communication services, and over-the-top (OTT) communication services.”

Parliament suspends 78 MPs in all; opposition calls this “murder of democracy”

On Monday, the Narendra Modi administration gave the impression that it was working toward an Opposition-must Parliament when it swiftly suspended 78 MPs because their “unruly” protests had compromised the August House’s decorum.

33 Lok Sabha members and 45 Rajya Sabha MPs are being targeted by the action, which was taken four days after 14 MPs, 13 of whom were from the Lower House, were suspended for the same offense of loudly calling for a statement from Home Minister Amit Shah regarding the security breach that occurred in Parliament on Wednesday.

An incensed opposition described the widespread suspension as a “bloodbath” and the “murder of democracy,” charging that the government was escalating the level of “tanasahi” (dictatorship) to stifle criticism.

Shah and Prime Minister Modi have continued to skip parliament since two young people on Wednesday stormed the Lok Sabha chamber brandishing smoke canisters. Nonetheless, they have addressed a portion of the media about the matter, charging that the Opposition is “politicizing the issue” and advising them to avoid demonstrations and calls for discussion.

Opposition members suspended in the current winter session have reached a record 92, divided equally between the two Houses (46–46). This feat, which a veteran described as unprecedented, occurred on a day when 78 MPs were suspended.

Additionally, the privileges committee of either House has been tasked with investigating the behavior of 11 of the 45 Rajya Sabha MPs and 3 of the 33 suspended Lok Sabha members. They are charged with serious offenses for which they will be suspended indefinitely if the committee finds them not guilty. For the current winter session, the remaining are suspended.

The mass suspension on Monday, according to former secretary-general of the Lok Sabha P.D.T. Achary, broke the record set by the 63 members who were removed from the assembly in 1989 for a single day of protesting the non-tableting of the Thakkar Commission report on Indira Gandhi’s assassination. 

Parliament operates with the participation of both the government and the Opposition, much like a cart on two wheels. Parliament cannot function in the true sense if one wheel is missing, Achary told the press.

During the post-lunch session, the Lok Sabha 33 was the first target of the axe before the Upper House repeated the play with 45 more scalps.

The suspended members of the Lok Sabha comprise senior leaders of the Congress and DMK, Adhir Chowdhury and T.R. Baalu, and DMK members N.K. Premchandran (RSP), Sougata Roy (Trinamul), A. Raja, and Dayanidhi Maran.

Sonia Gandhi, Rahul Gandhi, Sudip Bandyopadhyay of the Congress, and the Trinamul Congress are some of the notable figures that the Opposition INDIA bloc has left in the Lower House.

Regarding the Rajya Sabha, practically every member of the Opposition leadership has been removed. Among the names are those of Sukhendu Sekhar Roy (Trinamul), Ram Gopal Yadav (Samajwadi Party), Jairam Ramesh, K.C. Venugopal, Randeep Surjewala, Pramod Tiwari, and Shaktisinh Gohil (all Congress). Mallikarjun Kharge, the President of the Congress and Leader of the Opposition, has escaped unharmed.

Only 25–30 members of the INDIA bloc remain in the Upper House.

“The Prime Minister may speak with a newspaper, and the Home Minister may speak with television networks. But the Parliament, which speaks for the Indian people, has zero recourse against them! Kharge made a post on X.

“The Modi government can now crush dissent and bulldoze important pending legislation without any debate thanks to an Opposition-Less Parliament.”

“They want to run the House like their party office,” Adhir told reporters. Nothing would have come to pass if Amit Shah had spoken to the media rather than the House. We’ve been put on hold because we asked for his statement. Tanasahi is this person.

The chief of communications for the Congress, Ramesh, called the suspensions a “bloodbath” and created the acronym MODI, which stands for “murder of democracy in India.”

Ramesh wrote on X, “Not only in the Lok Sabha but today was a bloodbath in the Rajya Sabha with 45 INDIA party MPs getting suspended for demanding that the Leader of the Opposition be allowed to speak and for demanding a statement by the Home Minister on the December 13th security breach.”

Pralhad Joshi, the minister of Parliamentary affairs, defended the mass suspension, claiming that the Opposition had disregarded the Speaker’s repeated requests and had broken a unanimous decision to refrain from holding signs outside the newly constructed Parliament building.

“Mr. Speaker, you had asked the members not to carry signs inside the new Parliament building during the business advisory meeting. As opposition MPs demonstrated in the House Well during Question Hour early in the morning, Joshi stated, “Leaders of all the parties had supported it and given their consent that they will not bring placards.”

“This day hurts a lot. The House has devolved into a brigade of shouters. Dhankhar stated, “I have taken this (decision) with deep anguish,” before announcing the suspension of 45 lawmakers.

Piyush Goyal, the leader of the House, moved two motions: one to suspend 34 Members of Parliament and the other to suspend 11 more and refer their behavior to the privileges committee for review.

According to Congress Rajya Sabha member Kumar Ketkar, several of these 11 MPs were scheduled to retire in March. They may only get the traditional send-off if the privileges committee clear them by then.

Delayed BIS approval for sourcing units causes imported luxury shoe brands to stumble

Manufacturers claim that customers might be unable to help purchase the new spring-summer season launches, which have rocked the premium footwear market that sells designer, luxury labels, and high-end sports shoes. The Bureau of Indian Standards (BIS), which is required to approve imports from China and Vietnam, has not certified the footwear factories so that it may be removed from store shelves in the coming months.

The BIS Quality Control Orders (QCO) have been in effect for leather shoes since July, and they will take effect for sports shoes, sandals, and slippers in January 2024. To import and sell these products, factories that make these and specific vital components (like rubber, PVC, or polyurethane heels and soles) must receive certification from BIS per QCO standards.

Chief executive officers of five significant brands who wished to remain anonymous claim that BIS has not yet certified sourcing factories in China and Vietnam, where most imported shoes are sourced for India. According to their account, BIS officials have informed them that they have no interest in accrediting the factories in these markets and will exercise caution regarding manufacturing units in Southeast Asia, including Thailand, Indonesia, and Malaysia. This is because they fear that some of these units may be owned by the Chinese, as happens in Vietnam.

“Government officials have said to import from Europe, which will involve higher manufacturing cost and freight, impacting the pricing strategy in India or to manufacture in the country where the expertise for high-end, designer and sports footwear is still limited,” stated the CEO of a major shoe manufacturer.

According to a senior government official, the goal is to encourage homegrown manufacturing because a significant portion of cheap shoes was imported from China. He claimed that numerous extensions had already been requested since the industry, particularly the central and medium-sized firms, was informed of the QCO for 24 footwear and related products in October 2020.

According to the press, Nike had written to the government requesting that it accredit supplier factories in Vietnam and Indonesia to keep importing goods from those countries. Leading sports brand executives stated that although they have already imported the stock for spring, there will be an impact after that.

Specific luxury and premium brands import nearly their whole footwear collection, while other brands such as Woodland, Puma, and Adidas source their high-end and technical footwear from other countries. These imports primarily come from China, Vietnam, and some other Southeast Asian countries.
