Who is excluded from 1% TDS applicable on Payments made to E-Commerce companies

The Finance Act, 2020 has established a new Section 194-O that elaborates on levying 1 percent on TDS payments made to e-commerce operators. Section 194-O is applicable when Residents or Non-Resident e-commerce operators make payments to e-commerce platforms in relation to the sale of goods and services. 

An e-commerce operator is defined as a person who holds, manages or operates a digital or electronic facility for the sale of goods and services. Also, e-commerce operators are responsible for making payments to any e-commerce participant on sale of such products or services. These products or services include sale of digital goods and services such as podcasting, blogs etc.

Who is excluded?

A threshold limit of Rs. 5 lakhs is applicable for only resident individuals and Hindu Undivided Family (HUF). What this means is that an e-commerce operator does not need to deduct TDS if the amount (paid or credited) to individuals or HUF during the financial year does not exceed Rs. 5 lakhs.

Non-resident e-commerce participants are excluded or exempted from Section 194-O.

Scope of TDS on E-commerce under Section 194-O

The responsibility of payment of TDS lies with an escrow account between the buyer and seller. In other words, TDS is to be handled by e-commerce providers for the facilitation service of selling provision or goods of service furnished by it through its digital or automated facility or platform.

E-commerce providers are expected to deduct TDS during the credit or return period, whichever is faster.

Moreover, this section provides that if a purchaser of goods or service has earned the payment immediately to the e-commerce associate, it shall be assumed that an adjustment has been performed by the e-commerce executive or that the account has been charged by the e-commerce operator and the same shall be calculated in the entire amount for deduction of tax.

If the e-commerce participant does not publish their Aadhaar or PAN card, TDS has to be deducted at the rate of 5 per cent, according to the provisions of section 206AA.

What if the e-commerce participant is a non-resident?

Let us take an example. An e-commerce participant firm called Trader Ltd, sells its products through Amazon. Ms. Lina purchased this product online from Trader for Rs. 10,000 on the 1st of April, 2020.

Amazon credits Trader’s account on the 1st of April, 2020, but the customer directly makes the payment to Trader on the 15th of April, 2020.

Here, Amazon is needed to deduct TDS @1 percent on Rs. 10000 at the time of credit to the party or make the payment, whichever comes first. In such a scenario, TDS has to be deducted on the 1st of April, 2020.

Other provisions of Section 194-O on e-commerce transactions

All other left-out provisions of the chapter TDS of the Act are applicable. This includes submission of TDS form, provision surrounding the payment of TDS, other provisions related to non-deduction or lower deduction/non-submission of return/non-payment post deduction would be applicable as stated in the Act. The introduction of section 194-O would result in the upliftment of revenue for the government by minimizing tax evasion.

We ensured business continuity by selling handmade face masks, sanitizers, and other relevant items, which kept us afloat. It also ensured that the livelihoods of artisans were not disrupted.”

So what lies ahead for growth? It was from New Zealand that Rare Planet received its first international order, but now it has grown much beyond that. “We’ve recently launched our products into the international market, and it has been doing tremendously well. We plan to expand our offerings to more international markets. This way, we will also ensure better numbers for our artisans and achieve greater visibility as well. S Jaishankar, India’s foreign minister, is on a thank-you mission to Kuwait via Qatar

External Affairs Minister (EAM) S Jaishankar flew to Kuwait via Doha on Wednesday morning for a three-day visit to strengthen bilateral ties and express gratitude to the two countries for assisting India during the raging second wave of the Covid-19 pandemic by acting as a logistics hub for liquid medical oxygen supplies to western India.

Prime Minister Narendra Modi will meet with his counterpart Sheikh Ahmed Nasser al-Mohammad al-Sabah to discuss ways to strengthen ties in the energy, trade, investment, manpower, and information technology sectors while the EAM transports Prime Minister Narendra Modi’s personal letter to Kuwaiti Emir Sheikh Nawaf al-Ahmad al-Sabah.

Despite the fact that the S Jaishankar will transit through Doha on Qatar Airways, no meeting with Qatari leadership has been organized as of yet at the airport.

During the second pandemic in India, Kuwait, which has a large Indian community of over a million people, provided 5,267 oxygen cylinders, 450 metric tonnes of liquid medical oxygen, 66 oxygen concentrators, 11 ventilators, and other things such as medications, oximeters, masks, and gloves to India. From May 4 to June 8, Kuwait sent all of its medical assistance to India.

Qatar, which is India’s major LNG and LPG supplier, has also established itself as a major logistical and transportation hub for western India. Since August 2020, it has maintained a steady flow of passenger flights under the air bubble arrangement, particularly in recent weeks when several other Gulf airlines have shut down. In the current circumstance, Doha might become a new transit hub for Indians after the pandemic’s dust settles.

Qatar’s Emir, Sheikh Tamim Bin Hamad Al Thani, called Prime Minister Modi on April 27 to express his country’s solidarity with India and to assure him that Qatar will provide all available assistance. The Indian Ambassador in Doha would liaise with the Prime Minister’s office on the topic, according to the Prime Minister. The Emir quickly gave instructions to his foreign office to find out what India needed and to aid them.

Qatar Airways, one of the world’s major cargo carriers, declared on April 29 that it would transport crucial humanitarian medical cargo to India for free. Qatar Airways played a critical role in transporting foreign medical help to India. On May 3, Qatar Airways dispatched three cargo airplanes, one to Delhi, Bengaluru, and Mumbai, each carrying 300 MT of medical supplies sourced from around the world. It featured ventilators, CPAPs, oxygen concentrators, and personal protective equipment.

Qatar was also instrumental in supplementing India’s local production of liquid medicinal oxygen. Minister Dharmendra Pradhan met with his Qatari counterpart, Energy Minister Saad Al Kaabi, on May 1. The latter promised that Qatar Petroleum would take roughly 400 MT of liquid medical oxygen available to India every week.

The Indian community in Qatar, which numbers 700,000 people, also contributed generously, mobilizing 532 fully filled oxygen tanks and 43 oxygen concentrators. INS Kolkata delivered the first consignment of 200 completely filled oxygen cylinders and 43 oxygen concentrators on May 10, while INS Tarkash delivered the second consignment of 232 oxygen cylinders with capacities of 42 and 50 liters on May 12. Nagaland, Odisha, Bihar, and Telangana are among the states that have employed them.
