In an extremely horrifying sexual assault case that took place in the Nilambpur district of Kerala, a moral science teacher has been sentenced to 29 years and six months of prison by the special POCSO fast track court of Kunnamkulam. 

The incident took place in 2012 during a school picnic. The accused Abdul Rafeeq, 44, of Karadan House at Cheerakuzhy in Nilambur, worked at a private school in Puthumanassery in Pavaratty as a moral science teacher for primary classes. As per the statement given by the victim’s parents, after returning from the excursion she was found extremely weak and traumatized. The victim’s mother took notice of the changes and immediately took her to the hospital. The report of her medical examination brought light to the fact that she was horribly raped to the extent of her internal organs being damaged. The parents then approached the police, leading to the case. 

Considering the gravity of the crime, Fast Track Special Court (POCSO) justice M.P Shibu has additionally imposed a fine of ?2.15 lakh on Abdul. Also, if the accused fails in timely payment of the fine, he will have to serve an additional sentence of two years and nine months in prison. 

Reportedly on Friday, the Kerala high court also rejected the plea of another accused under the POCSO case to stop the legal proceedings on the grounds that he had married the minor whom he had violated. 

The court also stated that rape being an inhumane act as it is not only damages a victim’s body but also leaves a permanent stain on the mental state of the person. Such crimes even result in wrecking the mental state of the victim permanently. It is a shameful act committed not against an individual but rather the entire society. The Protection of Children from Sexual Offences Act (POCSO Act) was brought into force because of such far-reaching ramifications, the court added.
