The Calcutta High Court, on Friday, reserved its judgment on a Public Interest Litigation (PIL) questioning the Election Commission of India (ECI) on its constitutional urgency for holding By-polls for Bhabanipur Assembly Constituency in South Kolkata.

Following a petition by advocate Sabyasachi Chatterjee, Calcutta High Court on Thursday raised questions regarding the manner in which the Election Commission announced the dates to hold By-polls in the assembly constituency of Bhabanipur on the request of the West Bengal government. The PIL was filed by advocate Sabyasachi Chatterjee in which the division bench of the Acting Chief Justice Rajesh Bindal and Justice Rajarshi Bharadwaj asked the Election Commission to file an affidavit within a timeframe of 24 hours stating the law that empowered it. The hearing was concluded on Friday and a division bench comprising of Acting Chief Rajesh Bindal and Justice Rajarshi Bharadwaj reserved its judgment on the matter.

The Election to the high-profile Bhabanipur seat is scheduled for 30th September in which West Bengal Chief Minister Mamata Banerjee is contesting as All India Trinamool Congress candidate. She is taking on BJP’s Priyanka Tibrewal. The petitioner further claimed that the Election Commission of India (EC), in a press note, said that they have decided to hold the By-polls for the Bhabanipur seat “considering the constitutional exigency and special request from the State of West Bengal.” Pointing out to the unbiasedness of EC, the petitioner said Court needed to interfere in the matter.

Election Commission on its defense said that the petitioner is attempting to mischaracterize the word constitutional exigency, maintaining that there can be no possibility of the same being constructed as an influence on voters. Claiming that the state has no role in the decision to hold the By-polls in Bhabanipur and that it is the sole duty of the EC, the West Bengal government had on September 13 submitted before the court that the chief secretary had only written to EC requesting that the By-polls be held and that the commission had accepted the request.

Mamata Banerjee, who had earlier shifted from her traditional seat of Bhabanipur to Nandigram was defeated by TMC turncoat and BJP candidate- Suvendu Adhikari in the recently concluded Assembly Elections. As per the constitution, she needs to be elected as a Member of the Legislative Assembly (MLA) within a span of 6 months in order to retain her Chief Minister’s chair.

China denounced the India, United States, Australia, and Japan Quad grouping on Friday, saying the group will “find no support” ahead of the four countries’ first in-person leaders summit in Washington.

Foreign Minister spokesperson Zhao Lijian said in Beijing, “China always believes that any regional cooperation mechanism should not target or harm the interests of a third party. A closed, exclusive clique targeting other countries runs counter to the trend of the times and the aspirations of regional countries. It will find no support and is doomed to fail”.

He called on “relevant countries” to “view China’s development in a correct light and do more to promote solidarity and cooperation among countries in the region.”

In remarks made at a virtual Track II dialogue held on Thursday and published on Friday on the Chinese Embassy’s website in New Delhi, China’s Ambassador to India, Sun Weidong, also took aim at the Quad.

Mr. Sun said, “At present, some countries, with their ideological bias and Cold War mentality, vigorously seek closed and exclusive ‘small cliques’ with the aim of containing a third party, stoking bloc confrontation and geopolitical games”.

In remarks apparently aimed to serve as a warning to India on its increasingly close ties with the U.S., Mr. Sun added, “Once getting on someone else’s ship, one is no longer able to have the steer in control.” “Twenty years ago, when the U.S. started the Afghan war, many countries boarded its chariot. Twenty years later, what benefits have these countries gained? We should uphold true strategic autonomy, not only in words, but more importantly, in deeds,” he said, adding that “both sides should remove disruptions to mutual trust, refrain from interference in each other’s internal affairs or engagement in any ‘alliance’ or ‘quasi alliance’ targeting the other, and avoid being alienated by third party.”

A firing incident was reported in Rohini Court on Friday in which 2 from a rival gang were shot dead. Police informed that Jitender Gogi and his rival Sunil alias Tillu both were constantly seen in a fight that often ended in bloodshed. They have been running extortion rackets in Alipur and Sonipat for years, further destroying the peace of the nation. 

The incident occured in Rohini Court number 206 when the culprit Jitendra Singh was produced in the courtroom. The attackers were dressed as lawyers when they opened fire on the dreadful gangster Jitendra Singh. Three people were declared dead and one woman lawyer got injured. 

Delhi Police Commissioner Rakesh Asthana said, “The gangsters have been shot. Two came in their lawyer’s uniform. Police have neutralised them in counter move. Three casualties have been reported.”

Social media was flooded with shootout videos where lawyers are seen scrambling to get out of the building amid the sounds of gunshots in the background. People started criticizing the government and began to question them on their designation. One social media user also asked Amit Shah to resign from his post after seeing all the chaos that is happening in the courtroom despite the police personnel. 

“A team of the Northern Range of the Special Cell was accompanying Sunil Maan, who appeared half an hour before Gogi. Around 1.15 pm, Gogi was produced in the courtroom. The two assailants, identified as Rahul, a resident of Uttar Pradesh’s Baghpat, and Moris of Bakkarwala village, were standing at the entrance of the courtroom. They posed as lawyers and entered along with Gogi. Within seconds of entering, they opened fire on him from close range. Gogi received five-six bullet injuries; they fired eight-ten rounds,” said a police officer who was present in the courtroom at the time.

“Personnel of the Special Cell fired in retaliation. In total, eight rounds were fired by both the teams of the Special Cell. From the Northern Range of the Special Cell, Head Constable Kuldeep Hooda fired two rounds, and from the CounterIntelligence side, Head Constable Sandeep Dabas fired four rounds and Constable Rohit fired two. A third battalion also fired on the assailants with an AK-47,” an officer told The Indian Express, saying the two men died on the spot.

“For around 40 seconds, there was absolute chaos inside the courtroom,” the officer added. The local police were informed and Gogi was rushed to a hospital, but succumbed to the gunshot wounds.

Delhi Bar Association has asked the member to avoid coming to office on Saturday i.e 25th September, seeing the situation the courtroom is going through. 

“In view of the call by the Coordination Committee of all District Court Bar Association of Delhi, working in the court will be suspended due to revision of security norms on account of today’s unfortunate incident in Rohini Court, Delhi. All members are requested to abstain from their work on September 25,” a statement from Delhi Bar Association said.

Stock markets around the world have been keeping a close eye for any possible market turbulence as concerns keep growing over the possibility of massive defaults by one of the biggest Chinese real estate developers Evergrande Group.

The risks are high, that the embattled firm will default on upcoming payments later this week even as its chairman tried to lift confidence. The group’s shares have plunged nearly 80 percent this year and already faced multiple downgrades by rating agencies.

Angry home buyers are waiting while there are as many as 1.6 million apartments to be completed. Suppliers of cement, paint, and rebar are owed more than $100 billion in payments. Workers are panicking that loans they made to their employer cannot be repaid. Evergrande’s troubles have raised doubts among various share market experts that China’s residential and commercial property market, which drives up to a third of the world’s second-largest economy, could crumble.

 The disorderly collapse for a company of Evergrande’s size could cause ripple effects in China and beyond, including scaring off investors that have bet tens of billions of dollars on both the company and the property sector’s success.“If we’re in this downward spiral, then without a credible intervention we are going to see an awful lot of property developers getting into trouble,” said Michael Pettis, a finance professor at Peking University.

 While market observers once took as a given that Beijing would step in at the first sign of distress, now predict that Beijing will not intervene until other property developers begin to fail and pose a collective risk to the broader financial system.

 When it comes to Evergrande, Beijing is posed with two bad options. Regulators could step in and force state banks to give the company the money it needs to clear off the debts of suppliers, construction workers,  home buyers, etc. But this could lead to a bad example for other developers who would then continue bingeing in dept and fuelling an even bigger property bubble, something that Beijing has already stated as intolerable it could simply walk away and let Evergrande fall completely,  something it is ” unwilling to do because that could result in a collapse in the economy “.
