Former Indian Navy personnel’s death sentence is commuted by Qatar

Eight former Indian Navy officers received death sentences earlier this year, the sentences were reportedly commuted by a Qatari appellate court due to espionage charges.

“We have noted the verdict today of the Court of Appeal of Qatar in the Dahra Global case, in which the sentences have been reduced,” the Ministry of External Affairs (MEA) stated in a statement on Thursday, December 28. “The detailed judgement is awaited,” it continued. To determine the next course of action, we are in close communication with both the family members and the legal team.

After a Qatari court sentenced the men to death in October of this year, the MEA declared that it was “exploring all legal options.” What was the case, and what does this charge commutation mean for India? We explain.

Which eight former Navy men are in Qatar?

Eight former Indian Navy personnel were employed by Al Dahra Global Technologies and Consultancy Services, a defence services provider company, in Qatar. They were Captain Navtej Singh Gill, Captain Saurabh Vasisht, Commander Purnendu Tiwari, Captain Birendra Kumar Verma, Commander Sugunakar Pakala, Commander Sanjeev Gupta, Commander Amit Nagpal, and Sailor Rajesh.

On its former website, Al Dahra Global Technologies and Consultancy Services claimed to offer the Qatari Emiri Naval Force (QENF) maintenance, logistics, and training services. The company was identified as Dahra Global on the new website, and the connection to the QENF was not mentioned. The fact that the majority of the Indian officers held leadership positions was also left out. When they were detained, they had been employed here for four or six years by the State Security Bureau, a Qatari intelligence organization.

What accusations were made against the men?

In August 2022, the men were taken into custody. Arindam Bagchi, an MEA spokesman at the time, stated that inquiries regarding arrest charges “should be directed to the Qatari authorities.” Additionally, the family members and MEA representatives stated that they were not notified of the charges by Qatar.

According to sources, the Indians were supervising the induction of the Italian small stealth submarine U2I2 in their private capacity with Dahra Global. When the death sentences were announced, the Financial Times reported that “A person briefed on the case confirmed… that the eight Indians had been charged with spying for Israel.”

The final of the veterans’ several bail requests was denied in March 2023. Later that month, the trial got underway, and on October 26, the death penalty was imposed. S Jaishankar, the minister of external affairs, subsequently had a meeting with the men’s sentenced families.

The MEA declared in November that it had filed an appeal and that information about the charges was available to its legal counsel. On December 3, the Indian ambassador in Doha also had a meeting with them in prison. Days after meeting Qatar’s Emir, Sheikh Tamim bin Hamad Al-Thani, on the fringes of the COP28 conference in Dubai on December 1, Prime Minister Narendra Modi was granted consular access.

Which options have been open to India?

One was the legal challenge, which was accepted and initially assisted in reducing the sentence. India has been corresponding with Qatar through diplomatic channels at the same time.

The families also appealed for mercy to the Emir of Qatar, who is renowned for pardoning people during the holy months of Ramadan and Eid. With assistance from the Indian government, this was also being pursued.

India needed to secure a breakthrough because the case was confidential and the accused were former Indian defence personnel. Furthermore, Qatar and India have a close relationship and are significant partners. About 8 lakh Indian migrants are living in Qatar who remit money home. It sent the eighth-highest amount of remittances of any country in FY 2021–2022.

In addition to interpersonal relationships, there are strong defence and economic ties. “India’s total imports from Qatar in FY2022-23 were valued at $16.81 billion, of which LNG imports alone were worth $8.32 billion, or 49.5%, an analysis of official trade data shows,” the press reported. 

The relationship faced its first major setback in June 2022 when the Qatari government demanded that India issue a public apology for BJP spokesperson Nupur Sharma’s disparaging remarks about the Prophet on a TV show. India needed to defuse another source of tension in the ties in this particular context.

The actions also contain deliberately delaying or disrupting the business of the House, creating disorderly scenes through shouting, banging desks, or physical altercations, and refusing to withdraw from the House after being ordered to do so.

  • Misconduct in Committees:

Tampering with evidence or records presented to committees, disrupting committee meetings, misbehaving towards members, leaking confidential information from committee proceedings, and falsifying the Information. Some other misconducts are; Making false or misleading statements on the floor of the House, submitting forged documents, tampered evidence, and misrepresenting facts to the House or its committees.

  • Through Action or Speech outside the House:

Interfering with the Functioning of Parliament means inciting violence or protests that obstruct the functioning of Parliament, threatening or intimidating members of Parliament or staff, tampering with Parliament’s security or infrastructure, and scandalising or defaming the House. The reasons also include making public statements that bring the House or its members into disrepute, publishing false or misleading information about Parliament’s proceedings, or engaging in conduct that undermines the dignity and authority of the House. Along with them, the breach comprises disobeying summons or warrants i.e. refusing to appear before a parliamentary committee when summoned, failing to comply with a warrant issued by the House, and tampering with or obstructing the execution of a parliamentary order.

Specific Case of Derek O’Brien (Trinamool Congress, Rajya Sabha)

On December 13, 2023, Derek O’Brien, while protesting against the suspension of certain MPs, allegedly climbed on a table and shouted slogans, leading to a chaotic scene in the House. He Disrespected the Chair, addressed the Deputy Chairman in unparliamentary language, and questioned his impartiality. He also obstructed the proceedings, his actions reportedly stalled the House for a significant period. If proven true, these alleged actions could constitute a breach of privilege under various categories, including disrespecting the Chair, obstructing proceedings, and disorderly conduct. However, it is important to note that: No formal complaint has been filed against Mr. O’Brien as of December 14, 2023. He has denied any wrongdoing and defended his actions as legitimate protest. The Committee of Privileges would need to investigate the matter before any conclusive determination can be made.

The nature and severity of the breach determine the punishment, which can range from a mere reprimand to expulsion from the House. Parliamentary privileges are intended to uphold the dignity and functioning of the House, not to shield members from accountability for their actions. Adanis to invest Rs 9,350 Cr in the green energy arm

According to a company filing, billionaire Gautam Adani and his family will invest Rs 9,350 crore in the conglomerate’s green energy division to help it meet debt payment obligations and reach the 45 GW target by 2030. The plan to issue 6.31 crore warrants for Rs 1,480.75 each to the promoter group companies, Ardour Investment Holding Ltd and Adani Properties Pvt Ltd, was approved by the board of Adani Green Energy Ltd (AGEL) on Tuesday.

According to the company’s filing, the Rs 9,350 crore investment “will be used for deleveraging and accelerated capital expenditure” in AGEL. The promoter group companies would own 3.833 percent of the company after the investment. AGEL ended Tuesday’s trading session on the BSE at Rs 1,599.90, up 4.3%. The business has started laying out plans for repaying or refinancing $1.2 billion in bond maturities that are coming up in the upcoming year.

The infusion of funds is a component of Adani’s strategy for recovery, following the damaging accusations of corporate fraud made by Hindenburg Research in January. At its lowest point, the Adani group of companies’ market value dropped by more than $50 billion, despite the company’s denials of any misconduct. In the months that followed, some of that loss was regained.

The renewable energy developer already has land of over 2,00,000 acres (equivalent to over 40 GW of additional capacity) in resource-rich areas and a Power Purchase Agreement (PPA) tie-up of 19.8 GW (out of 20.6 GW locked in capacity, balance of 800 MW being merchant).
The company’s board authorized the preferential issuance of warrants to the promoters for a total of Rs 9,350 crore for Rs 1,480.75 per share. The company aims to have 45 gigawatts (GW) of green energy capacity by 2030.

A company statement stated that the issuance is contingent upon approval from regulatory and statutory authorities, as well as the company’s shareholders at the Extraordinary General Meeting (EGM) on January 18, 2024.

AGEL had earlier disclosed that eight of the top international banks were providing a $1.36 billion construction facility for 2,167 MW of solar power projects in Khavda, Gujarat, the largest solar park in India. Additionally, AGEL announced the announcement of $1.425 billion in equity capital, or more than $3 billion in capital raised ($1.125 billion from preferential issuance by promoters and $300 million from TotalEnergies JV).

Russian oil imports hit an 8-month low as discounts decline and OPEC shares increase

Moscow’s portion of India’s oil imports fell to an eight-month low in October as a result of declining discounts on Russian crude oil, while New Delhi’s traditional West Asian suppliers, Iraq, Saudi Arabia, and the United Arab Emirates (UAE), were able to reclaim some of the market share they had given up to Russia.

The Indian Express analyzed official trade data from India and found that, in terms of volume, Russia’s share of India’s oil imports decreased to 31.9% in October from 34.8% in September. It fell for four months in a row from the highest recorded level of 44.7% in June.

However, after rising steadily month over month since June, the combined share of Saudi Arabia, the United Arab Emirates, and Iraq reached a seven-month high of 44.1% in October. Over the last few months, OPEC’s (Organization of the Petroleum Exporting Countries) share of India’s oil imports has recovered primarily due to higher crude supplies from these three nations.

The percentage of OPEC in India’s oil imports increased to 50.2% in October from 49.1% in September. When Russian oil shipments to India began to pick up speed in April 2022, the cartel of foreign oil suppliers held a 71.3% share. The UAE, Saudi Arabia, and Iraq combined accounted for nearly 61 percent of New Delhi’s oil imports. OPEC comprises ten other member countries in addition to these three.

The government does not release grade-wise oil import data, so the average landed price of crude and import volumes from the supplying countries were used for computations, even though the price of crude oil varies greatly depending on grades.

Iraq, Saudi Arabia, and the United Arab Emirates were India’s top crude suppliers before the conflict in Ukraine, with Russia having a minor role. But after Moscow invaded Ukraine in February 2022, the West started to shun Russian oil, so Russia started to offer steep discounts to those who were willing to buy. When Indian refiners began snatching up the cheap barrels, Russia shot to the top of India’s list of oil suppliers. On the list, the UAE, Saudi Arabia, and Iraq have all dropped a spot.

Industry insiders have stated that over the past few months, several factors—such as high oil price volatility, high and opaque shipping and insurance charges, competition from Chinese refiners, export cuts by Russia, and the nation’s domestic demand for petroleum products, the lax enforcement of the West’s price cap on Russian oil, and Moscow’s ability to get around the restrictions—have significantly reduced the discounts on Russian oil.

The trade data analysis indicates that in October, the difference between the average delivered price of oil from Iraq, Saudi Arabia, and the United Arab Emirates and the delivered price of Russian crude, including freight and insurance, was only 5.7%, following a four-month decline. from Iraq, Saudi Arabia, and the United Arab Emirates was only 5.7% in October, down from a peak of 22.7% in June for four months in a row. Comparably, the difference between the average price of oil received from all OPEC suppliers and the discount on Russian oil dropped for four months in a row, from 23.1% in June to 6.9% in October.

Based on trade data, calculations show that Indian refiners saved approximately $3.3 billion in the first half of the current financial year (FY24) by purchasing discounted Russian crude oil. The estimated savings for April through November are $3.55 billion.

Because Russian oil cargo prices are so opaque, it is unclear what the actual discounts are since Indian refiners began increasing their imports of Russian oil. In contrast to oil from the majority of other suppliers, Russian crude is purchased by Indian refiners on a delivered basis, meaning that in addition to the cost of the oil itself, the cargo price also includes the cost of freight and insurance. As a result, a comparison between the average landed price of Russian crude and the average price of oil imported from other suppliers serves as the best available marker for discounts.
