Mamta Banerjee can still become CM even after losing Nandigram

Despite losing the assembly election in Nandigram to BJP’s Suvendu Adhikari — a defeat her party has said she will appeal — Mamata Banerjee will easily retain her position as West Bengal’s chief minister.

The provisions for taking the oath as a minister are laid out in Article 164 of the Indian Constitution. “A Minister who for any period of six consecutive months is not a member of the Legislature of the State shall at the expiration of that period cease to be a Minister, “ according to Article 164(4).

In other words, Banerjee will have six months to get re-elected as Chief Minister of Bengal in a by-election from any Bengal constituency. Banerjee was a member of Parliament when she took oath as Chief Minister for the first time in 2011, as she had not run in the assembly elections. She was elected from Bhabanipur after a few months.

“Constitutionally, legally and morally, no one can or should object to Mamata Banerjee becoming the CM and getting elected within six months. If anyone objects, it would not only be churlish but would also betray a lack of knowledge of the Indian constitution, “ said Abhishek Singhvi, Congress leader and legal expert.

The TMC’s victory in the state is it’s third in a row, solidifying Banerjee’s grip on the state, which had seemed tenuous just a few weeks ago. It also boosts her national status in a non-BJP, non-Congress coalition. The fact that she defeated a slew of national leaders, including Prime Minister Narendra Modi, would undoubtedly enhance her reputation as a warrior.

Banerjee overcame anti-incumbency and a slew of defections orchestrated by the BJP, including her one-time protege Adhikari, who defeated her in Nandigram, with a focus on welfare schemes and a campaign depicting her as “Bengal’s daughter.”

“In Parliament, as in state legislatures, there is a provision for being a minister first and then being elected later. According to Article 75, paragraph 5 of the Constitution, “A Minister who for any period of six consecutive months is not a member of either House of Parliament shall at the expiration of that period cease to be a Minister.”

India ready to receive its first dose of Sputnik-V from Russia

According to Kirill Dmitriev, the head of the Russian Direct Investment Fund (RDIF), India will receive its first doses of Sputnik-V, a Russian-made coronavirus vaccine, on Saturday, as Covid-19 cases and deaths have risen dramatically in the region, with more than 300,000 new infections registered daily for the past nine days.

Dmitriev said in a statement, “The first doses will be delivered on May 1.”He did not specify how many vaccines would be included in the first batch or where they would be manufactured. He hoped that the Russian-made vaccine would aid India in averting the crisis caused by Covid-19’s second wave.

The Sputnik-V shipment, which was authorized by an advisory panel earlier this month, would help India prepare for the pandemic, as many states have complained about vaccine shortages, forcing them to change their vaccination plans.

It will soon be included in India’s vaccine program, and it is hoped that this will help the country’s recovery from the pandemic. In step III of its vaccination campaign, India started vaccinating people over the age of 18 on Saturday.

Earlier this year, the RDIF signed agreements with five major domestic manufacturers for over 850 million doses. It has also set a target for India to produce more than 50 million doses per month by the summer. Prime Minister Narendra Modi spoke with Russian President Vladimir Putin earlier this week about how Sputnik-V was a useful weapon in the battle against Covid-19.

Turkey, Chile, and Albania are the new countries to approve Sputnik-V, joining 60 others. Several analysts believe the Sputnik-V vaccine, which was initially met with skepticism, is a ‘scientific and political victory’ for Putin and Russia. The creators of Sputnik-V, Gamaleya Research Centre, have repeatedly said that the vaccine is the best Covid-19 vaccine in the world.

Maharashtra to hit by third wave of Covid-19 by Jul-Aug says CM, Uddhav Thackeray

Even though the second wave has yet to subside, Maharashtra is expected to be struck by a third wave by July or August, according to epidemiologists consulted by the government. He urged the state administration to plan for the third wave by bolstering infrastructure, stating that he did not want to see a replay of the current situation.

On Thursday, the CM convened a conference of divisional commissioners and district collectors to assess the Covid situation. Rajesh Tope, the state’s health minister, said, “We will have to become self-sufficient, especially in oxygen supply. The CM said he did not want to hear any reason for the shortage of oxygen supply then.”

The forecast is based on the recommendations of members of the state task force, which includes medical experts. They predicted after studying the patterns of Covid waves in different countries.

According to experts, a decrease in daily cases will likely begin by the end of May, but by the end of July or the first week of August, cases will begin to rise again, signaling the start of the state’s third wave, according to a senior official who requested anonymity.

The Health Minister said, “We want the local administration to be at an oxygen surplus by July. For this, orders for setting up 125 PSA (Pressure Swing Absorption (PSA) technology) plants have been issued and in the next 10 days, their installation will begin across the state. District collectors have been directed to procure 5 to 10 LPM oxygen concentrators in proportion to 25% of the total active patients in their respective district so that all mild and serious patients will be able to get regular oxygen supply in any case.”

Officials said that epidemiologists believe the situation is stabilising as a result of the lockdown, and that regular cases may begin to decline as early as next month.

A senior official privy to the development said, “In the next two months, the situation will come under control but as soon as all the restrictions are lifted it is believed that the third wave will again hit the state.” 

Asking to ensure an adequate supply of medicines for the third wave, CM said, “ The situation has come under control to some extent owing to the strict restrictions but we have to be cautious and start planning for the third wave.”

Tope stated that tele-ICU facilities would be built for tertiary care of patients in all two-tier cities without a major government hospital or medical college as part of the preparations. Every patient’s bed will be equipped with high-resolution cameras, allowing expert doctors in major cities to monitor their condition.

He has also ordered a fire audit, a structural audit, and an oxygen supply audit. District collectors have been instructed to ensure that hospitals complete these audits on time.

As compared to the previous two months, the death toll in March was 2,495 people, while in February, when a second wave struck the state, 1,072 people died. According to a state health department report, the mortality rate rose to 0.70 percent this month (between April 1 and 27) from 0.38 percent last month. It was introduced at a meeting of the state cabinet on Wednesday.

According to Dr Subhash Salunkhe, state advisor on the Covid-19 and former director-general of health services, the virus is behaving strangely, which is adding to the death toll.
