Uttrakhand Bhu Kanoon: Dhami Government bans land purchases by outsiders

Devendra Khati |

You’ve likely heard whispers of the “Bhu Kanoon,” a law governing land acquisition in the enchanting state of Uttarakhand. But amidst the murmurs, what exactly is it, and how can you navigate its intricacies to buy property legally and ethically?

Latest Update On Bhu Kanoon: Uttarakhand bans land purchases by outsiders.

The Uttarakhand government has temporarily prohibited individuals outside the state from purchasing land within its borders for agricultural and horticultural purposes.

Under the directive of Chief Minister Pushkar Singh Dhami, all District Magistrates in Uttarakhand are instructed to reject any attempts by non-residents to acquire land in the state for agriculture or horticulture. This measure will remain effective until the five-member drafting committee, established by the State government to thoroughly assess the report submitted by the committee on land laws (‘bhoo kanoon’), presents its findings to the government.

This decision comes in response to protests in the state’s capital, Dehradun, led by various social organizations united under the banner of ‘Mool-Niwas Bhoo-Kanoon Samvanya Sangharsh Samiti’. These groups have advocated for restrictions on large-scale land sales in Uttarakhand to individuals outside the state. Additionally, they have called for an extension of the minimum residency period required for non-Uttarakhand residents to obtain a domicile certificate.

What is Bhu Kannon?

Firstly, “Bhu Kanoon” translates to “Land Law” in Hindi, serving as Uttarakhand’s cornerstone of property ownership. It’s a tapestry woven with complex threads, addressing the delicate balance between safeguarding local interests and fostering development. Introduced in 2002, it aimed to protect the state’s indigenous population while welcoming responsible investment.

One central tenet of the Bhu Kanoon restricts non-residents from purchasing land, exceptions notwithstanding. Land ownership might seem like a distant dream if you haven’t graced Uttarakhand with your presence for at least 15 years. However, pathways still exist. Establishing a business or a non-profit organization within the state’s borders unlocks doors, allowing you to contribute while reaping the rewards of land ownership.

The law has yet to escape criticism. Some view it as an excessive barrier, hindering progress and investment. Others argue it’s a shield safeguarding the land rights of locals facing growing scarcity. This very debate prompted the formation of a dedicated committee in 2023. Tasked with reviewing the existing legislation and proposing reforms, their report eagerly awaits release, potentially shaping the future of land acquisition in Uttarakhand.

Uttrakhand Bhu Kanoon: A Roadmap to Land Ownership in Uttrakhand Bhu KannoUttarakhand

Navigating land acquisition in Uttarakhand can feel like deciphering an ancient riddle. The state’s Bhu Kanoon, also known as the Land Law, serves as the guiding principle, but its intricacies can perplex even the most seasoned investor. Let’s shed some light on its key provisions:

Restricted Access for Outsiders: Generally, if you last called Uttarakhand home at least 15 years ago, buying land directly might seem like a distant dream. However, the law isn’t a brick wall.

Exceptions for Committed Residents: You can purchase land if you’ve diligently integrated into the local community for over 15 years. This provision recognizes your contribution to the state’s social fabric.

Entrepreneurial Pathway: Aspiring entrepreneurs and those seeking to establish non-profit organizations in Uttarakhand can rejoice! Setting up a business or a non-profit opens the door to land ownership, fostering a win-win situation where your venture flourishes alongside your connection to the land.

Limited Land Holdings: While the Bhu Kanoon welcomes responsible outsiders, it also prioritizes the interests of residents. Non-residents can only purchase up to 250 square meters of land, ensuring equitable distribution and preventing large-scale land acquisition by outsiders.

Governmental Scrutiny: Every land purchase by a non-resident requires prior approval from the government. This meticulous process ensures adherence to the law and protects the state’s interests.

ZEE opposes the Sony merger termination action by moving NCLT

TheIndiaSaga Team |

Zee Entertainment Enterprises Ltd. (ZEEL) announced on Wednesday that it has approached the National Company Law Tribunal, Mumbai bench, seeking directions to implement the merger scheme, two days after Japan’s Sony Corporation called off the merger plan.

The company said it has started the proper legal action to refute Culver Max and BEPL’s claims in the arbitration proceedings before the Singapore International Arbitration Centre (SIAC) in a stock exchange filing.

In response to Culver Max and BEPL, “the company specifically denied any breach of its obligations under the MCA (merger co-operation agreement) and reiterated that the company has complied with all its obligations in good faith,” ZEEL stated.

“The claim for termination fee is legally untenable and has no basis whatsoever,” the statement read. “The company has denied that Culver Max and BEPL are entitled to terminate the MCA.”

ZEEL claimed that Sony Arms, Culver Max, and BEPL had failed to carry out the National Company Law Tribunal-approved plan and to give it effect. “ZEEL stated that the company has demanded that Culver Max and BEPL promptly revoke the termination and affirm that they will fulfil their responsibilities to give effect to and carry out the merger plan, approved by the NCLT.”

National Tourism Day: History and Theme of 2024

TheIndiaSaga Team |

India observes National Tourism Day on January 25 to raise awareness of travel. The Indian government founded it to increase public understanding of the value of tourism to the country’s economy. This day honors the tourism sector and raises awareness of its role in developing and sustaining travel destinations and local economies. In addition, the day keeps foreign guests who come to learn about India’s rich history, traditional cuisine, and cultural heritage. Interestingly, in 2022, the Government of India’s initiative Azadi ka Amrit Mahotsav included a significant portion of the National Tourism Day celebrations.

The purpose of National Tourism Day is to raise awareness of the value of tourism throughout the world. It also brings attention to tourism’s social, political, economic, and cultural services.

India provides a variety of tourism experiences, including business, cultural, natural, heritage, and educational. Significant advancements have also been made in sports, rural living, medicine, cruises, and ecotourism. In India, national policies for the growth and promotion of tourism are formulated by the Ministry of Tourism, the designated authority. The public sector, as well as federal and state agencies, are coordinated by the ministry. India is one of the most sought-after travel destinations for tourists worldwide because of its rich historical, cultural, and geographical diversity.

More than 15.3% of Indian workers are employed in the travel and tourism sector, according to statistics. Millions of foreign visitors come to the nation yearly (for example, 7.42 million in 2014). National Tourism Day aims to honour and promote the tourism sector and its role in developing and sustaining travel destinations and local economies. On September 27, 2023, India also participated in the UN World Tourism Day celebrations; India even hosted this event in 2008.

The theme of National Tourism Day 2024

Each year, a new theme serves as the focal point for the celebration of National Tourism Day. “Sustainable Journeys, Timeless Memories” is this year’s theme. It highlights the idea of thoughtful and responsible travel. The central government organizes this day’s seminars, cultural events, and other programs. However, several states host events to advertise tourism in their area.

From Saffron to Trianga: How Flag Colour Changes in India

TheIndiaSaga Team |

The nation that went high on the celebration of the consecration of Ram Lalla a few days ago will shift its trends to remember the democratic and republic essence of India that are enriched in the constitution. On Monday, 22 January, India was filled with joy. It cherished the welcome of their beloved Ram Lalla after the exile of 500 years. Every street in the country is decorated with rich flowers and saffron flags.

Also, Ram Bhajan being played in the temples overwhelmed the citizens. However, as Republic Day came, this atmosphere changed from a civilisational carnival into a national festival. The saffron flags changed into tricolour, and patriotic songs were playing. This is the beauty of India; this is what ‘unity in diversity’ means.

According to independent observers, we have studied this trend, saluting two flags—one religious and the other national—magnifies having two identities. According to a senior political analyst who wished to remain anonymous, “It shows that most people who bought both flags are accepting the bhagwa dhwaj as their identity, but consider the tricolour as their national identity.” French philosopher Jean Jacques Rousseau says it is an expression of the individual and collective will.

When it comes to choosing the identities between personal beliefs and national will, the Patriotism of Indians for their motherland is superior even to heaven. An Indian Patriotic is always ready to lay down his life in the service of his country, India. Patriotism is not mere passive love for the country. A true patriot who loves India is an active worker and protector of its democratic and republican ethos and always respects its diversity. He works heart and soul for his India and his fellow citizens’ progress. Patriotism inspires a patriot to revolt and fight for his country’s freedom.
